The Netherlands is the EU's primary gateway for soy imports. The Port of Rotterdam receives soybeans and soy meal from Brazil and Argentina, supplying Europe's animal feed manufacturers, food processors and biofuel producers. Major traders and processors including Bunge, Cargill, ADM and Louis Dreyfus operate crushing and processing facilities in the Rotterdam port area.
The EUDR places the due diligence obligation squarely on the EU-based operator — the entity that places the soy on the Union market for the first time. For Dutch importers and traders, this means every incoming lot requires a filed DDS in TRACES NT before customs clearance.
Under Article 4 and Annex II, the data fields you must submit are defined by law. Your supplier provides the raw data. You structure it into the DDS and file it.

Under Article 2(15), the operator is the person who places the product on the EU market for the first time. For soy entering through Rotterdam, that is the Dutch importer or trader. Your Brazilian or Argentine supplier provides data. You file. Delegating this to the exporter does not discharge your legal obligation.
Article 10.2(m) of Regulation (EU) 2023/1115 classifies voluntary certifications — including RTRS, ISCC, ProTerra and organic — as complementary evidence for the risk assessment. They are not a substitute for the Due Diligence Statement. A DDS must be filed in TRACES NT for every lot regardless of certification status.
Soy passes through multiple aggregation stages: farm, local silo, regional elevator, crushing plant, port of Santos or Rosario. Only the coordinates of the production plot satisfy the regulation. Your supplier or their cooperative provides the GPS coordinates of production plots. Under Article 25, consequences apply to the operator placing non-compliant products on the EU market. In the Netherlands, the NVWA (Nederlandse Voedsel- en Warenautoriteit — Netherlands Food and Consumer Product Safety Authority) and Dutch Customs are the competent authorities.
Article 25.2(a). For a Dutch trader with €10M EU turnover, the minimum fine starts at €400,000. The maximum may exceed the economic benefit gained from the infringement.
Article 25.2(b) and (c). The soy shipment and all revenues from its transaction may be seized by Dutch customs.
Article 25.2(d). Temporary exclusion from tendering procedures, grants and concessions.
Article 25.2(e). In serious or repeated cases, prohibition on placing relevant products on the EU market until full compliance is demonstrated.
Under Article 25.5, every final infringement decision is published by the Commission.
