Terms and conditions

General contracting conditions for SolidwareTools products, in accordance with Spanish Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users) and Directive 2011/83/EU on consumer rights.

1. Identification of the service provider

2. Subject matter

These Terms and Conditions govern the acquisition of usage licenses for digital products marketed under the SolidwareTools brand. The catalogue includes, among others: EAA-Report, GPSRCheck, BrechaCheck and the rest of the document generators in the catalogue. These conditions apply to all products equally unless otherwise expressly stated on the corresponding product page.

3. Nature of the products

SolidwareTools products are digital content products, not services. Purchasing any of the licenses grants the buyer a personal and non-transferable usage license of the corresponding document generator, during a 30-day window from activation, with a maximum of 10 regenerations per license to correct or update data.

The processing of data entered by the user and the generation of the resulting PDF are carried out entirely in the user's browser. SolidwareTools never stores or receives the data entered into the generator, regardless of the product used.

The PDF generated by the user is their indefinite property and can be used, kept, and published without time limit, even after the license closes after 30 days.

4. Price and payment method

Each SolidwareTools product has its own price, clearly and prominently displayed on the corresponding product page before purchase. All products follow the same model: a single payment per document, with no subscription or automatic renewals. As a reference: EAA-Report €99 per website, GPSRCheck €49 per SKU, BrechaCheck €29 per incident. Prices may change without affecting licenses already activated.

Payment processing is carried out through Gumroad, Inc., which acts as Merchant of Record. Gumroad is responsible for collecting payment, issuing the invoice to the buyer, and complying with the corresponding tax obligations (European VAT, US sales tax, etc.) according to the buyer's jurisdiction.

5. Purchase process

  1. The user accesses the corresponding product page and reviews the information.
  2. Before purchasing, the user can take the free applicability test available on each product page to verify whether the tool is right for their situation.
  3. The user clicks the purchase button, which redirects them to the secure Gumroad platform.
  4. The user completes the data requested by Gumroad and confirms the payment.
  5. Once the payment is confirmed, the user receives by email the license key and the link to the generator.
  6. The user activates the license by entering the key in the generator, completes the required data, and downloads the resulting PDF.

6. Right of withdrawal

SolidwareTools products are digital content delivered through download of the PDF generated in the buyer's browser. In accordance with Article 103.m of Spanish Royal Legislative Decree 1/2007 (transposition of Article 16.m of Directive 2011/83/EU), the right of withdrawal does not apply to digital content whose execution has begun with the buyer's prior express consent and with their acknowledgement of losing the right of withdrawal.

The activation of the license and the effective generation of the PDF constitute the act of delivery of the digital product and the beginning of its execution with the buyer's express consent. This condition applies equally to all products in the SolidwareTools catalogue.

7. Intellectual property

The document generators, the legal templates, the country-by-country legal databases, the formats of the generated PDFs, the source code of the products, and all the commercial brands of the SolidwareTools catalogue (including EAA-Report, GPSRCheck, BrechaCheck and the others) are the exclusive intellectual property of the owner of SolidwareTools. The acquisition of a license grants the buyer the right to use the corresponding generator and the indefinite ownership of the resulting PDF, but does not transfer the intellectual property of the underlying product.

The user may not resell the license, redistribute the generator, or use it for report generation services to third parties without express written authorisation from the owner.

8. Limitation of liability

SolidwareTools guarantees that the structure of the documents generated by its products follows the European regulatory framework applicable to each case (Directive 2019/882 and EN 301 549 for EAA-Report; Regulation (EU) 2023/988 for GPSRCheck; GDPR for BrechaCheck; etc.) and that the legal references by country are correct as of the date of the latest verification published in each product.

SolidwareTools does not guarantee that a specific document generated by its products will be accepted by a market surveillance authority in a specific case, or by a commercial buyer in a procurement process, or that the use of the document will exempt the buyer from their own legal responsibilities arising from non-compliance with the applicable regulations.

SolidwareTools products are self-assessment tools where the responsibility for compliance lies with the economic operator, not with SolidwareTools as the provider of the tool.

The content of the products and the website does not constitute legal advice. For complex or high-risk situations, the buyer should consult a qualified legal professional.

9. Technical support

The buyer is entitled to technical support during the validity of the license (30 calendar days from activation) to resolve technical problems in the use of the generator. Support is provided exclusively by email at hello@solidwaretools.com.

Technical support covers software failures, PDF generation errors, and questions about how the generator works. It does not cover legal advice, interpretation of the regulations applicable to the buyer's case, or reviews of the substantive content of the generated report.

10. Product modifications and free updates

SolidwareTools periodically updates the legal and technical content of each product when the underlying regulation changes. Updates are free for buyers with an active license, and the most recent version is always available with the same license key.

11. Out-of-court dispute resolution

In accordance with Regulation (EU) 524/2013 on online dispute resolution for consumer disputes, buyers residing in the European Union have the right to access the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

12. Applicable law and jurisdiction

These Terms and Conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the consumer's place of residence, in accordance with Article 90.2 of Royal Legislative Decree 1/2007.
