EUDR — Reglamento de Deforestación
¿Una certificación Fairtrade o Rainforest Alliance sustituye la DDS del EUDR?
No. El Artículo 10.2(m) del Reglamento (UE) 2023/1115 clasifica las certificaciones voluntarias como evidencia complementaria, no sustitutiva. El operador europeo debe presentar una DDS completa conforme al Art. 4 y Anexo II independientemente de las certificaciones que posea el proveedor.

¿Cuándo entra en vigor el EUDR?
30 de diciembre de 2026 para operadores y traders. 30 de junio de 2027 para micro y pequeñas empresas. Fechas extendidas por el Reglamento (UE) 2025/2650 del 23 de diciembre de 2025.

¿Qué coordenadas GPS exige el EUDR?
Art. 2(28) y Anexo II punto 4: geolocalización a nivel de parcela de producción. Puntos para parcelas menores de 4 hectáreas, polígonos para parcelas de 4 hectáreas o más. Sistema WGS-84, formato GeoJSON conforme a RFC 7946.

¿Cuáles son las multas por incumplimiento del EUDR?
Art. 25.2(a): multas de al menos el 4% de la facturación UE anual. Art. 25.2(b-c): confiscación del producto y sus ingresos. Art. 25.2(d): exclusión de contratación pública UE hasta 12 meses. Art. 25.2(e): prohibición temporal de comercialización en la UE en casos graves o reincidentes.

¿Un exportador de café colombiano necesita documentación EUDR?
Sí. Colombia está clasificada como riesgo estándar bajo la clasificación de mayo de 2025. Se requiere DDS completa conforme al Art. 4 + Anexo II para todas las exportaciones de café a la UE. EUDRCheck genera el dossier completo en 15 minutos por 199 €.

GPSR — Seguridad General de Productos
¿Necesito documentación GPSR para vender en Amazon EU?
Sí. Amazon exige activamente documentación GPSR para listings en sus marketplaces europeos desde abril de 2024. Se requiere: expediente técnico con análisis de riesgo interno (Art. 9), declaración UE de conformidad, y etiqueta con datos obligatorios del fabricante e importador. ¿El marcado CE es suficiente para cumplir con el GPSR?

¿Un fabricante chino necesita GPSR para exportar a Europa?
Sí. Bajo el Reglamento (UE) 2023/988, la obligación principal de producir el expediente técnico del Art. 9 recae sobre el fabricante, independientemente de su ubicación. El importador europeo le exigirá esta documentación antes de importar el producto.

EAA — Accesibilidad Europea
¿La European Accessibility Act aplica a empresas fuera de la UE?
Sí. Si tu servicio digital (web, app, SaaS) está disponible para consumidores de la UE, la EAA aplica independientemente de dónde esté constituida tu empresa. El ámbito de aplicación se define en los Artículos 1 y 2 de la Directiva (UE) 2019/882.

AI Act — Inteligencia Artificial
¿Qué documentación técnica exige el AI Act para sistemas de IA de alto riesgo?
El Artículo 11 y el Anexo IV del Reglamento (UE) 2024/1689 requieren documentación técnica completa: descripción general del sistema, elementos del sistema de IA, proceso de desarrollo y datos de entrenamiento, monitorización y pruebas, sistema de gestión de riesgos, sistema de gestión de calidad (Art. 17).

¿Cómo sé si mi sistema de IA es de alto riesgo bajo el AI Act?
El Anexo III del Reglamento (UE) 2024/1689 lista las categorías de alto riesgo: biometría, infraestructuras críticas, educación, empleo, servicios esenciales, fuerzas del orden, migración, justicia. El Artículo 6 define los criterios de clasificación detallados.

¿Cuáles son las multas del AI Act?
Hasta 35 millones de euros o el 7% de la facturación global anual por prácticas de IA prohibidas (Art. 5). Hasta 15 millones de euros o el 3% por otras infracciones. Las PYMES tienen un régimen sancionador reducido.

EUDR — Deforestation Regulation
Does Fairtrade or Rainforest Alliance certification replace the EUDR Due Diligence Statement?
No. Article 10.2(m) of Regulation (EU) 2023/1115 classifies voluntary certifications as complementary evidence only, not as a substitute for the DDS. The European operator must submit a complete DDS under Art. 4 and Annex II regardless of the supplier's certifications.

When does the EUDR apply?

What GPS coordinates does the EUDR require?

What are the fines for EUDR non-compliance?
Article 25.2(a): fines of at least 4% of EU annual turnover. Art. 25.2(b-c): confiscation of commodity and revenue. Art. 25.2(d): exclusion from EU public procurement for up to 12 months. Art. 25.2(e): temporary ban on EU market placement in serious or repeated cases.

GPSR — General Product Safety Regulation
Do I need GPSR documentation to sell on Amazon EU?
Yes. Amazon has been actively enforcing GPSR documentation requirements on its European marketplaces since April 2024. Sellers need an Article 9 technical file with internal risk analysis, EU Declaration of Conformity, and product label with mandatory manufacturer and importer data. Does CE marking satisfy GPSR requirements?

EAA — European Accessibility Act
Does the European Accessibility Act apply to non-EU companies?
Yes. If your digital service (website, app, SaaS) is available to EU consumers, the EAA applies regardless of where your company is incorporated. Directive (EU) 2019/882, Articles 1 and 2.

What are the fines under the EU AI Act?
