Three mistakes HR tech companies make

COMMON MISTAKE

"We use a checklist — that's our compliance documentation"

Checklists are guides, not regulatory documentation. Article 11 requires a specific nine-point technical documentation file per Annex IV. A checklist verifies what you should do. Annex IV documentation proves you have done it.

"Our screening algorithm does not use personal data — GDPR does not apply, so AI Act might not either"

The AI Act and GDPR are separate regulations. The AI Act classifies systems by their PURPOSE (screening candidates), not by the data they process. Even if your system processes only anonymised data, the purpose — screening candidates — triggers Annex III.4(a) classification.

Frequently asked questions — Automated candidate screening and the AI Act

Does automated screening include keyword matching in CVs?
If the keyword matching uses a machine learning model to infer relevance scores, rank candidates, or weight keywords by learned patterns, it is an AI system under Art. 3(1). If it is a simple Boolean search without inference, it may not qualify. The test is whether the system infers outputs that influence candidate selection.
Does the AI Act apply to screening tools used outside the EU by EU-based employers?
Article 2.1(b) applies to deployers (employers) established in the EU, regardless of where the AI system is provided from. If the screening tool is used by an EU employer, the provider obligations apply as the system is in use in the EU market.
We are a UK-based screening tool provider with EU clients. Does Art. 2 apply?
Yes. Article 2.1(a) applies to providers placing AI systems on the EU market, regardless of where the provider is established. If your UK tool screens candidates for EU clients, it is placed on the EU market.
Our screening tool is used by both EU and non-EU clients. One documentation set?
Yes. Annex IV documentation covers the AI system, not the client. One set of twelve documents covers your system regardless of how many clients use it.
Is this a subscription?
