Three mistakes recruitment software providers make

If you are a recruitment platform provider, claiming compliance without Annex IV documentation is a liability. Compliance means having the twelve-document technical file ready for market surveillance authorities. A compliance badge on your website is not documentation.

"Our clients (HR departments) should handle AI Act compliance"

HR departments are deployers under Art. 3(4). They have deployer obligations (Art. 26). But Annex IV documentation is a provider obligation (Art. 11). You build the system — you document it. Your clients cannot document your architecture, training data, and performance metrics. Only you can.

COMMON MISTAKE

Frequently asked questions

What's the difference between provider and deployer for recruitment AI?
Under Regulation (EU) 2024/1689: the provider (Art. 3(3)) is the company that develops or places the AI system on the market. The deployer (Art. 3(4)) is the company that uses it. If you build recruitment software, you are the provider. If a corporation uses your software in their HR process, they are the deployer. Provider obligations include Annex IV documentation (Art. 11), quality management (Art. 17), and post-market monitoring (Art. 72). Deployer obligations include human oversight (Art. 26) and worker information.
Does AI Act apply to ATS (Applicant Tracking Systems) with AI features?
If the ATS uses AI components for screening, ranking, or recommending candidates, those components fall under Annex III.4(a). A basic keyword-match ATS without machine learning may not be in scope. An ATS with AI-powered candidate ranking, semantic matching, or automated shortlisting is in scope.
Can I use AICheck documentation as proof of compliance for RFPs?
