Three mistakes HR tech companies make

Frequently asked questions — Annex III category 4 documentation

What is the exact scope of category 4(d) — task allocation?
Annex III.4(d) of Regulation (EU) 2024/1689 covers AI systems intended to be used for allocating tasks to workers based on individual behaviour, personal traits, or characteristics. This includes workforce scheduling systems that use algorithmic profiling, AI-driven shift allocation based on worker performance scores, and task distribution engines that factor in behavioural data.
Does a system that only collects employee data but does not evaluate it fall under category 4?
If the system collects data without AI-driven inference, it may not fall under the AI Act definition (Art. 3(1)). However, if the collected data feeds into an AI component that evaluates, scores, or ranks employees, the AI component is in scope. The data collection tool alone is not; the integrated system is.
Can one AICheck licence cover multiple subcategories if my system does both 4(a) and 4(c)?
Each AICheck licence documents one AI system. If your system performs both recruitment screening (4(a)) and performance monitoring (4(c)), it is one system with multiple high-risk use cases. One documentation set covers it. You describe both use cases during input, and AICheck structures the Annex IV file to address both.
Does the AI Act require us to disclose our model architecture to competitors?
No. Article 78 protects confidential business information. Technical documentation is shared with market surveillance authorities under confidentiality obligations, not published. Your model architecture remains proprietary.
