Three mistakes HR tech companies make

COMMON MISTAKE

"We read the AESIA guideline, we can document internally"

The AESIA guideline explains what documentation must contain. It does not generate it. Translating 62 pages of regulatory guidance into a structured nine-point Annex IV file requires cross-referencing Articles 9, 11, 13, 17, 47, 72, and 73. AICheck does that mapping automatically.

COMMON MISTAKE

"Our system only suggests — a human always decides"

Human-in-the-loop does not remove the high-risk classification. Annex III.4 classifies the system based on its intended purpose (screening, evaluating, allocating), not on whether a human reviews the output. A suggestion engine for candidate ranking is still classified under 4(a) if it influences hiring decisions.

COMMON MISTAKE

"We already have GDPR documentation — DPIA covers AI Act"

A DPIA under Article 35 GDPR assesses data protection risks. Annex IV under the AI Act requires system-level documentation: training data methodology (point 2(d)), performance metrics (point 3), bias testing (point 2(g)), and risk management (point 1). These are different documents with different purposes.

Frequently asked questions — HR AI system documentation

Does AICheck cover all four subcategories of Annex III category 4?
Yes. Category 4 includes (a) recruitment and candidate selection, (b) decisions on promotion, termination, or working conditions, (c) monitoring and evaluation of worker performance and behaviour, and (d) task allocation based on individual behaviour or personal traits. AICheck adapts the Annex IV documentation to the specific subcategory you select during input.
Is a performance review tool with AI components high-risk?
If the tool uses AI to evaluate, score, or rank employee performance, and those evaluations influence employment decisions (promotion, termination, bonuses), it falls under Annex III.4(c) of Regulation (EU) 2024/1689. A tool that only visualises data without AI-driven inference may not be in scope. Use the free AICheck checker to verify.
We provide HR AI to clients in the US and EU. Do we need separate documentation?
The Annex IV documentation obligation applies when the system is placed on the EU market (Art. 2.1(a)). If the same system is deployed in both markets, one set of Annex IV documentation covers the EU obligation. US clients may have separate requirements under emerging state-level AI laws, but those are outside AICheck scope.
Does the AI Act require us to disclose our model architecture to competitors?
No. Article 78 protects confidential business information. Technical documentation is shared with market surveillance authorities under confidentiality obligations, not published. Your model architecture remains proprietary.
Is this a subscription?

Can I request a refund?
