Frequently asked questions — EdTech AI and the AI Act
Does the AI Act apply to EdTech companies outside the EU?
Yes. Article 2.1(a) applies to providers who place AI systems on the Union market, regardless of where the provider is established. If any school, university or training institution within the EU uses your EdTech product, you are placing it on the EU market. The documentation obligation applies.
What about AI-powered tutoring systems — are they high-risk?
AI tutoring systems that provide explanations, suggest resources or answer questions are generally not covered by Annex III, Section 3. They may have transparency obligations under Art. 50. However, if the tutoring system also evaluates learning outcomes, that evaluation component falls under Section 3(b) and requires documentation.
An online classifier flagged our system as high-risk. What's next?

Does the AI Act distinguish between K-12 and higher education?
No. Annex III, Section 3(a) covers AI systems intended to determine access or admission to educational and vocational training institutions "at all levels." Primary, secondary, higher education and vocational training are all covered equally.
