Three mistakes Indian manufacturers make about EU cybersecurity documentation

"BIS certification covers EU cybersecurity requirements"

BIS certifies for the Indian market. It has no relevance to EU Directive 2014/53/EU. The cybersecurity requirements are governed by EU legislation, EU standards (EN 18031), and EU enforcement authorities.

Art. 10(1) and 10(3) place the obligation on the manufacturer. The importer (Art. 12) must verify — but cannot do it for you.

Frequently asked questions

My importer in Germany sends a 15-point checklist. Is RED cybersecurity one of those points?
Likely yes. EU importers under Art. 12(2) must verify cybersecurity documentation from 1 August 2025.
I export to the UK as well. Does this apply there too?
Directive 2014/53/EU is EU-specific. The UK has its own framework (UKCA). Check current UK guidance.
Can I use Module A (self-declaration) instead of going through TÜV?
Yes, if you fully apply EN 18031. Art. 17(3)(a) allows Module A.
Does Art. 3(3)(e) apply to Bluetooth earphones?
If they are wearable (worn on head) and process personal data, Art. 1(2)(d) triggers Art. 3(3)(e) even without internet. If they also connect to internet via app, Art. 3(3)(d) applies.
