Three mistakes Indian electronics factories make about EU cybersecurity compliance

If your earphones connect to a phone app that transmits data to the internet, they communicate indirectly. Art. 3(3)(d) applies. If they are wearable (worn on head) and process personal data, Art. 1(2)(d) triggers Art. 3(3)(e) as well.

Art. 10(1) and 10(3) place the documentation obligation on the manufacturer. If products are sold under your brand, you are the manufacturer. If the importer sells under their brand, Art. 14 makes them manufacturer — but they will contractually require YOU to provide the documentation.

Frequently asked questions

My UK importer says I need BOTH CE for EU AND separate UKCA for UK. Is that correct?
Post-Brexit, UK has its own framework. UKCA is separate from CE. The UK has extended CE recognition for radio equipment. Check current UK guidance.
I manufacture under multiple brands for different importers. Do I need separate documentation?
Documentation is per product TYPE. Same hardware/firmware under different brands uses the same cybersecurity documentation — but each brand requires its OWN EU Declaration of Conformity (Art. 14).
Our Bluetooth speaker only plays music. No app, no cloud. Does this apply?
If the speaker ONLY connects via Bluetooth for audio streaming, with no internet connectivity whatsoever, Art. 3(3)(d) may not apply. Verify ALL functions: firmware updates, pairing app data transmission, etc.
