Three mistakes lending fintechs make

"We need an enterprise compliance programme first"

An enterprise programme covers governance, training, and process design. That is valuable, but Article 11 requires specific documentation per Annex IV. The documentation can be generated now. The governance programme can run in parallel. Do not let a €50K programme delay a €249 documentation task.

Frequently asked questions — Lending algorithms and the AI Act

Is a Buy Now Pay Later (BNPL) algorithm covered by Annex III.5(a)?
If the BNPL algorithm evaluates the creditworthiness of the applicant to decide whether to approve the deferred payment, it falls under Annex III.5(a) of Regulation (EU) 2024/1689. BNPL is a credit product. The AI system evaluating eligibility is a creditworthiness assessment system. High-risk classification applies.
We use a third-party scoring API (e.g. Experian, FICO). Who documents?
If you integrate the third-party API into your lending product and place it on the EU market under your name, you may become the provider under Art. 25. The Annex IV documentation obligation would be yours. The API provider may have their own documentation, but your system's documentation must cover the integrated whole.
Does the Consumer Credit Directive interact with AI Act documentation?
Yes. Directive (EU) 2023/2225 (Consumer Credit) requires creditworthiness assessment. The AI Act adds documentation obligations for the AI system performing that assessment. Both frameworks apply simultaneously. AICheck covers the AI Act obligations; CCD compliance is a separate legal requirement.
Is this a subscription?

Can I request a refund?
