Three mistakes UK companies make about EU RED cybersecurity

COMMON ERROR

"We have UKCA — that covers us for the EU too"

Since 1 January 2021, UKCA is valid only in Great Britain. For the EU27 market, you need CE marking under Directive 2014/53/EU. The cybersecurity requirements of Art. 3(3)(d) and (e) apply to CE, not UKCA.

"We already have CE marking for EMC and safety"

Your existing CE covers EMC and safety. The cybersecurity requirements are NEW obligations activated from 1 August 2025. Separate assessment required.

"Post-Brexit, we sell through an EU distributor — they handle compliance"

If you place the product under YOUR name, you are the manufacturer under Art. 10. If your EU distributor imports from the UK, they are the importer under Art. 12 — and must verify that YOU have drawn up documentation.

Frequently asked questions

Does UKCA cover any EU cybersecurity requirements?
No. UKCA is the UK domestic marking. It does not satisfy any requirement of Directive 2014/53/EU or Delegated Regulation (EU) 2022/30.
Do I need an EU-based authorised representative?
Under Art. 12, an EU-based importer must place the product on the market. You may also appoint an authorised representative under Art. 11.
Can I use Module A?
Yes, if you fully apply EN 18031. Art. 17(3)(a).
My distributor says docs are my responsibility. Correct?
Yes. Art. 10(1) and 10(3).
CRA?
Repealed from 11 December 2027.
