Three mistakes eBay sellers make about RED cybersecurity

COMMON ERROR

"I already have CE marking — my listings should not be flagged"

CE marking for electromagnetic compatibility (Art. 3(1)(b)) and electrical safety (Art. 3(1)(a)) has been mandatory since 2016. The cybersecurity requirements of Art. 3(3)(d) and (e) are SEPARATE obligations activated by Delegated Regulation (EU) 2022/30 from 1 August 2025. Your existing CE marking does not cover them. eBay now requires documentation that specifically addresses cybersecurity.

COMMON ERROR

"I'm a seller, not a manufacturer — compliance is the factory's job"

Art. 14 of Directive 2014/53/EU: if you sell under YOUR brand — even if a factory made the product — you ARE the manufacturer under EU law. Art. 10 obligations apply to you: design compliance, technical documentation, conformity assessment.

COMMON ERROR

"I'll delist the product from eBay EU and sell only on eBay UK or US"

eBay UK requires UKCA marking (separate regime). eBay US has no cybersecurity documentation requirement under RED — but if you sell into the EU from ANY eBay domain, Directive 2014/53/EU applies to products received by EU buyers. Cross-border sales do not exempt you.

Does eBay enforce cybersecurity documentation the same way Amazon does?
Both platforms require conformity documentation as a condition for maintaining active EU listings. The legal basis is the same: Directive 2014/53/EU and Delegated Regulation (EU) 2022/30. eBay's enforcement may differ in timing and process, but the underlying regulatory obligation is identical.
I sell on eBay UK and eBay DE. Do I need separate documentation?
eBay UK operates under the UK regulatory framework (UKCA marking). eBay DE operates under EU law (CE marking, Directive 2014/53/EU). These are separate regimes. Your EU cybersecurity documentation does not cover the UK, and UK documentation does not cover the EU. For EU listings, REDCheck generates the required documentation.
I sell under my own brand but the factory makes everything. Am I really the 'manufacturer'?
Yes. Art. 14 of Directive 2014/53/EU states: an importer or distributor who places radio equipment on the market under his own name or trade mark is considered a manufacturer and is subject to the obligations of Art. 10.
What happens when the CRA replaces the RED cybersecurity requirements?
Delegated Regulation (EU) 2022/30 will be repealed with effect from 11 December 2027, when the Cyber Resilience Act — Regulation (EU) 2024/2847 — enters full application.
