Three mistakes Amazon sellers make about RED cybersecurity

COMMON ERROR

"I already have CE marking — my listings should not be suspended"

CE marking for electromagnetic compatibility (Art. 3(1)(b)) and electrical safety (Art. 3(1)(a)) has been mandatory since 2016. The cybersecurity requirements of Art. 3(3)(d) and (e) are SEPARATE obligations activated by Delegated Regulation (EU) 2022/30 from 1 August 2025. Your existing CE marking does not cover them. Amazon now requires documentation that specifically addresses cybersecurity.

COMMON ERROR

"I'm a seller, not a manufacturer — compliance is the factory's job"

Art. 14 of Directive 2014/53/EU: 'An importer or distributor shall be considered a manufacturer [...] where he places radio equipment on the market under his name or trade mark.' If you sell under YOUR brand — even if a Shenzhen factory made the product — you ARE the manufacturer under EU law. Art. 10 obligations apply to you: design compliance, technical documentation, conformity assessment. The factory only made the hardware. The legal responsibility is yours.

COMMON ERROR

"I'll just change the listing to remove WiFi/Bluetooth mentions"

Amazon product compliance is based on the physical product, not the listing text. Removing 'WiFi' from your listing does not change the fact that the product contains a radio module. Market surveillance authorities test actual products, not listings. Misrepresenting product capabilities may also violate Amazon's terms of service and consumer protection law.
