Common mistakes

COMMON ERROR

"CE marking is just the European version of FCC"

CE marking is a self-declaration of conformity with ALL applicable EU Directives — not just radio emissions. For radio equipment, it covers electrical safety, EMC, radio spectrum AND cybersecurity since Delegated Reg. 2022/30. FCC covers only radio emissions. They are not equivalents.

COMMON ERROR

"We'll handle EU compliance after we get traction"

Art. 10(1) of Directive 2014/53/EU: manufacturers shall ensure compliance WHEN PLACING on the market. You cannot legally place non-compliant equipment on the EU market to test demand. The first unit sold is the first violation.

"Our EU distributor will handle the regulatory side"

A distributor (Art. 13) makes the product available after it has been placed on the market. The distributor verifies documentation exists — they do not produce it. If you are the manufacturer (Art. 10), the documentation obligation is yours.

What EU compliance documents do I need for my radio equipment?
For radio equipment sold in the EU: CE marking based on conformity with ALL applicable essential requirements; EU Declaration of Conformity (Art. 18 + Annex VI); technical documentation under Art. 21 + Annex V including cybersecurity; simplified declaration with label (Art. 10(9) + Annex VII). Do I need an EU authorized representative or importer?
As a US manufacturer, you need either an authorized representative in the EU (Art. 11) or an EU-based importer (Art. 12). Most US companies entering via Amazon use an importer of record service.
Can I apply for CE marking from the US?
CE marking is not an application process — it is a self-declaration by the manufacturer. You affix CE marking yourself after completing the conformity assessment and drawing up the EU Declaration of Conformity. No application, no approval, no waiting.
Is the EU cybersecurity requirement permanent or temporary?
The current requirements under Delegated Reg. 2022/30 are in effect from 1 August 2025 to 11 December 2027. From that date, the Cyber Resilience Act (Reg. 2024/2847) takes over. The documentation obligation is permanent — the legal basis changes but the requirement remains.
Is it a subscription?
