Three mistakes importers of Ukrainian steel make with CBAM documentation

Mistake 1 — Assuming Ukraine is exempt because of the association agreement

Annex III lists four countries: Iceland, Liechtenstein, Norway, Switzerland. Ukraine is not among them.

The EU-Ukraine Association Agreement does not automatically exempt Ukraine from CBAM. Exemption under Art. 2(6) requires that the EU ETS applies or a full linking agreement exists. Until that condition is met, CBAM applies to all Ukrainian steel imports without exception.
