Frequently asked questions — AI in recruitment obligations EU 2026

Does the 2 August 2026 deadline apply to all recruitment AI or only new systems?
Article 111 of Regulation (EU) 2024/1689 establishes that obligations for high-risk AI systems listed in Annex III apply from 2 August 2026. This applies to systems placed on the market or put into service from that date. Systems already in operation have transitional provisions but must comply when significantly modified.
Does the AI Act apply to recruitment AI used for internal promotions?
Yes. Annex III.4(a) covers recruitment and selection of natural persons. Annex III.4(b) covers decisions on terms, conditions, promotion, and termination. Internal promotion decisions using AI are within scope.
Our company operates in the UK and EU. Do we need separate documentation?
The AI Act applies to the EU market. The UK has its own AI regulatory approach. If the same recruitment AI system is used in both markets, the Annex IV documentation covers the EU obligation. UK requirements, when enacted, may require separate compliance.
