Insurance AI documentation mistakes

"Our actuarial models are statistical, not AI — the AI Act does not apply"

Article 3(1) defines AI systems broadly. If your risk assessment model uses machine learning, neural networks, or statistical inference that goes beyond traditional deterministic actuarial tables, it may qualify as an AI system. A gradient-boosted model that predicts claim probability is AI. A lookup table based on age and postcode is not.

"EIOPA will issue sector-specific guidance before we need to act"

EIOPA has published a factsheet and is actively developing guidance. But the Annex IV documentation obligation comes from the Regulation directly — not from EIOPA guidance. Annex III.5(b) specifically covers life and health insurance risk assessment and pricing. Property and casualty insurance is NOT explicitly listed in Annex III.5(b). Frequently asked questions — Insurance AI and the AI Act

Does Annex III.5(b) cover motor insurance pricing AI?
Annex III.5(b) explicitly covers risk assessment and pricing in "life and health insurance." Motor insurance is not explicitly listed. However, if your motor insurance pricing AI assesses the creditworthiness of a natural person (Annex III.5(a)), it may be classified under a different category. We use a third-party AI model from a vendor for underwriting. Who documents?
If the vendor develops the AI model and you deploy it, the vendor is the provider (Art. 11 obligations) and you are the deployer (Art. 26 obligations). Does the AI Act interact with EIOPA's AI governance expectations?
