Three mistakes Amazon white-label sellers make about RED cybersecurity

COMMON ERROR

"I'm a seller, not a manufacturer — I don't owe documentation"

Art. 14 of Directive 2014/53/EU: an importer or distributor who places radio equipment on the market under his own name or trade mark is considered the manufacturer and is subject to the obligations of Art. 10. If the product says your brand on the box, you are the manufacturer. All manufacturer obligations apply — including technical documentation under Art. 10(3).

COMMON ERROR

"My supplier in Shenzhen has CE marking — that covers cybersecurity"

CE marking obtained by your supplier covers Art. 3(1)(a) (safety) and Art. 3(1)(b) (EMC). The cybersecurity requirements of Art. 3(3)(d) and (e) are SEPARATE obligations activated from 1 August 2025. Furthermore, by placing the product under YOUR brand, you assumed manufacturer status under Art. 14. The existing CE marking under the supplier's name is no longer valid for your branded product.

COMMON ERROR

"I already solved the GPSR issue — that should be enough"

GPSR (Regulation (EU) 2023/988) and the Radio Equipment Directive (Directive 2014/53/EU) are separate pieces of EU legislation. GPSR covers general product safety. RED cybersecurity covers network protection and personal data. Solving one does not solve the other. Amazon checks both.

Yes. Art. 14 of Directive 2014/53/EU: 'An importer or distributor shall be considered a manufacturer for the purposes of this Directive and he shall be subject to the obligations of the manufacturer under Article 10, where he places radio equipment on the market under his name or trade mark.' If the product bears your brand, you are the manufacturer.
Amazon gave me 30 days. Is that enough time?
