The AI Act covers AI systems, not just products. Article 3(1) defines an AI system regardless of its delivery method. A SaaS product that uses AI is an AI system. Whether it runs on your server in Istanbul or on AWS in Frankfurt, if EU clients use it, Article 2.1(a) applies.

You document the AI system, not the client deployment. If every client uses the same model with the same training data and the same configuration, one dossier covers the system. Frequently asked questions — Turkish SaaS and the EU AI Act

Does the AI Act apply to SaaS delivered from Turkey via cloud?
Yes. Article 2.1(a) applies to providers who place AI systems on the Union market, regardless of where the provider is established. A SaaS product delivered from a Turkish server to an EU client is being placed on the Union market. The delivery method — cloud, on-premise, API — is irrelevant.
We use a shared model across all clients. Do we need one dossier or many?
If every client uses the same model with the same training data, the same architecture and the same configuration, one Annex IV dossier covers the system. Multi-tenancy does not create separate systems. However, if you fine-tune models per client or deploy different versions, each version is a separate system.
Our SaaS handles HR screening for EU companies — is that high-risk?
Yes. Annex III, Section 4(a) classifies AI systems used for recruitment and selection, including screening and filtering applications, as high-risk. If your Turkish SaaS screens CVs, ranks candidates or filters applicants for EU clients, it is high-risk and requires Annex IV documentation.
