Deployer without documentation: the numbers

Art. 25 of Regulation (EU) 2024/1689 establishes responsibilities along the value chain. You become the provider if you put your name on the system or modify it substantially.

Art. 26.1 requires the deployer to use the system in accordance with the instructions of use. No documentation = no instructions = non-compliance. Art. 13 requires the provider to enable deployers to interpret the system's output — the Annex IV documentation is how.

Request documentation formally
Send a written request to your provider asking for Annex IV technical documentation per Art. 11. Keep a record with the date.

Assess the response
If the provider delivers, review it. If the provider refuses, delays or says it doesn't exist, you have a documented gap.

Deployer mistakes when the provider has not documented

An email claiming compliance is not Annex IV documentation. Article 11 requires a structured technical dossier with 9 sections. A statement of compliance is a claim. The dossier is evidence. Ask for the 12 documents.

"We are just the deployer — the documentation gap is the provider's problem"

The documentation gap is the provider's failure. But it becomes your problem under Art. 26.1. You cannot use a high-risk AI system in accordance with instructions that do not exist. The supervisory authority can ask what measures you took. "We waited" is not a measure.

"We modified the system — but only slightly"

Article 25.1(c) states that a deployer who makes a "substantial modification" becomes the provider. If you fine-tuned the model, changed the training data, altered decision thresholds, or retrained on your own data, you may already be the provider. The documentation obligation is already yours.

Frequently asked questions — Deployer without provider documentation

If I generate the documentation myself, do I automatically become the provider?
Not automatically. Article 25 states that you become the provider if you place your name on a high-risk AI system, or if you make a substantial modification. Generating the documentation is a step towards assuming the role, but the formal conversion depends on whether you meet any of the Art. 25 conditions. Consult a lawyer.
What if I don't have access to the provider's training data?
You document what you know about your deployment. If you do not have the provider's training data, document the gap and describe the data as characterised in the provider's published materials. A documented gap is better than no documentation.
