Proctoring and the AI Act: the numbers

Annex III, Section 3(d) covers AI systems that monitor and detect prohibited behaviour. It does not require the system to make a final decision. If your AI flags potential cheating for human review, it is still monitoring behaviour during tests. The classification applies regardless of whether a human makes the final call.

Article 2 of Regulation (EU) 2024/1689 applies to providers who place AI systems on the Union market, regardless of where the provider is established. If any EU university uses your proctoring software, you are placing it on the EU market. The documentation obligation under Art. 11 is yours as the provider.

Frequently asked questions — Proctoring software and the AI Act

Does Annex III, Section 3(d) apply to all proctoring software?
Annex III, Section 3(d) covers AI systems intended to be used for monitoring and detecting prohibited behaviour of students during tests. If your proctoring software uses AI to analyse student behaviour — eye-tracking, face detection, keystroke dynamics, browser activity monitoring — it falls under this section. Passive video recording without AI analysis is not covered.
What if our proctoring system is used outside the EU?
Article 2.1(a) applies to providers who place or put into service AI systems in the Union market. If your system is used by any university or institution within the EU, the obligations apply regardless of where your company is established. A single EU client triggers the documentation requirement.
Can we use the same dossier for all universities that use our system?
If every institution uses the same version with the same model, the same training data and the same configuration, one dossier covers the system. If you offer customised deployments per institution — different models, different training data, different thresholds — each deployment is a separate system and needs its own documentation.
Does the documentation need to cover student data specifically?
Annex IV, Section 2(d) requires a description of the data used for training, validation and testing, including the data collection methods. If your proctoring system was trained on student exam recordings, that data must be described in the documentation — origin, size, characteristics, bias measures. AICheck structures this section automatically.
Is this a subscription?
