Admission algorithms and the AI Act: the numbers

Annex III, Section 3(a) classifies AI systems that determine access or admission to educational institutions at all levels as high-risk. "At all levels" — primary, secondary, university, vocational training.

The deadline is 2 August 2026. Full obligations for Annex III high-risk systems enter into force on that date under Article 113 of the Regulation.

Annex III, Section 3(a) covers AI systems intended to determine access or admission. Ranking applicants is determining access — the committee works from the AI-generated ranking. The human-in-the-loop does not remove the classification. The algorithm shapes the decision space.

Article 3(1) defines AI system broadly. Machine-learning-based systems, statistical approaches, and systems that infer from input data to generate outputs such as predictions, recommendations or decisions are covered. A logistic regression model that scores applicants is an AI system under the Regulation if it meets the Art. 3(1) definition.

Article 11 applies to the provider of the high-risk AI system. Under Art. 3(3), the provider is the entity that develops or has developed an AI system with a view to placing it on the market or putting it into service. A university department that develops and deploys an admission algorithm internally is both provider and deployer. The documentation obligation applies.

Frequently asked questions — Admission algorithms and the AI Act

Does Annex III, Section 3(a) cover automated shortlisting tools?
Yes. If an AI system filters, ranks or shortlists applicants for educational admission, it is determining access. Annex III, Section 3(a) covers AI systems intended to determine access or admission. Shortlisting is a determination of access — applicants who are filtered out lose access.
What about scholarship allocation algorithms?
If an AI system determines which applicants receive scholarships that are a condition of access to the institution, it falls under Section 3(a). If the scholarship is supplementary and not a condition of admission, the classification may not apply. Assess whether the AI decision effectively determines access.
We retrain the model each year with new applicant data. Do we need to re-document?
Article 11.1 requires the technical documentation to be kept up to date. If you retrain with new data, the training data description, performance metrics and bias test results change. Regenerate the documentation after each retraining cycle. AICheck allows regeneration within your licence period.
KU Leuven published a paper on this — does academic analysis replace documentation?
