Deployer with a non-compliant provider: the numbers

Art. 25 of Regulation (EU) 2024/1689 establishes responsibilities along the value chain. You become the provider if you put your name on the system or modify it substantially.

Request documentation formally
Send a written request to your provider asking for Annex IV technical documentation per Art. 11. Keep a record with the date.

Article 26.1 requires you to use the system in accordance with the instructions of use. The absence of instructions does not eliminate your obligation — it makes compliance impossible. The supervisory authority can ask what measures you took upon discovering the absence. Inaction is not a defence.

A deployer policy pack organises your internal processes under Art. 26 — risk monitoring, log retention, incident reporting. It does not produce Annex IV technical documentation. Frequently asked questions — Art. 26 deployer with non-compliant provider

Does Art. 26 impose fines on deployers specifically?
Yes. Article 99.4 provides for fines of up to €7,500,000 or 1% of total worldwide annual turnover for deployers who fail to comply with their obligations. These are deployer-specific fines, separate from the provider fines under Art. 99.3.
What if I have already modified the provider's system?
If you have made a substantial modification, Article 25.1(c) considers you the provider. The Art. 11 documentation obligation is yours. A substantial modification includes changes to the algorithm, retraining with new data, or changing the intended purpose. If unsure, consult a lawyer — but err on the side of documenting.
Can I use AICheck documentation in a dispute with my provider?
The documentation demonstrates the structure and effort required to comply with Annex IV. It can serve as evidence that you took measures to close the compliance gap. Whether it strengthens your position in a commercial dispute depends on your contract and applicable law.
What does Fronterio's deployer guide recommend when the provider is non-compliant?
Fronterio's EU AI Act Compliance Guide for Deployers describes the deployer obligations under Art. 26 and recommends contractual safeguards with providers. It does not provide a mechanism to generate the documentation when the provider fails. AICheck is that mechanism.
