LVD test reports, EMC assessments, and RED technical files follow harmonised standards and notified body procedures. GPSR applies to non-harmonised products with a different framework: Art. 9(2) requires an internal risk analysis, a general product description, and identification of relevant European standards applied. A CE marking template does not map to this structure.
Article 2(1) of Regulation (EU) 2023/988 is explicit: GPSR applies to those aspects and risks or categories of risks which are not covered by sector-specific Union harmonisation legislation. A product fully compliant with RED or LVD may still have unaddressed risks — particularly for vulnerable consumers, foreseeable misuse, or product categories likely to attract children (Art. 6(1)(e) and (f)).
A CE marking consultancy that cannot offer GPSR documentation for non-harmonised products forces the client to find a second provider. That second provider will propose handling all directives together — LVD, EMC, RED, and GPSR. The client leaves not because of price, but because of convenience. Regulation (EU) 2023/988 has been applicable since 13 December 2024. These are the consequences for non-compliance.
Article 44 of Regulation (EU) 2023/988. Each Member State defines the penalty amounts applicable to economic operators and providers of online marketplaces. Penalties must be effective, proportionate and dissuasive.
Article 9(8). When a product is found to be dangerous, the manufacturer must immediately take corrective measures — including withdrawal or recall — and inform authorities through the Safety Business Gateway.
Article 26. Dangerous products are notified through the Safety Gate Rapid Alert System and published on the Safety Gate Portal — visible to all consumers, competitors, and marketplace operators across the Union.
