Three mistakes that cost CE marking firms time and clients

Pattern 1 — Using harmonised directive templates for GPSR

GPSR has its own documentation structure

LVD test reports, EMC assessments, and RED technical files follow harmonised standards and notified body procedures. GPSR applies to non-harmonised products with a different framework: Art. 9(2) requires an internal risk analysis, a general product description, and identification of relevant European standards applied. A CE marking template does not map to this structure.

Pattern 2 — Assuming that products with CE marking are exempt from GPSR

GPSR applies to risks not covered by harmonised legislation

Article 2(1) of Regulation (EU) 2023/988 is explicit: GPSR applies to those aspects and risks or categories of risks which are not covered by sector-specific Union harmonisation legislation. A product fully compliant with RED or LVD may still have unaddressed risks — particularly for vulnerable consumers, foreseeable misuse, or product categories likely to attract children (Art. 6(1)(e) and (f)).

Pattern 3 — Not offering GPSR documentation as a service

If the client goes elsewhere for GPSR, the entire account follows

How do the 70 licenses work?
Each license is activated with a unique code and is associated with one specific product and manufacturer. One license equals one GPSR technical documentation dossier. The 70 licenses are used independently. They do not expire as a block — each one has its own 30-day editing window from its individual first activation.
Can I request a refund?
The pack is a digital product governed by Article 16(m) of Directive (EU) 2011/83 on consumer rights. By activating the first license and expressly confirming PDF generation, the buyer consents to the downloadable digital content nature of the product and waives the right of withdrawal. Refunds are accepted only for reproducible technical failures (generator error, PDF that does not download, verifiable bug) within 14 calendar days of purchase.
What if the regulation changes?
Unused licenses will generate the dossier using the updated version of the generator at no additional cost. GPSRCheck is updated within 48 hours of any regulatory change published in the Official Journal of the European Union.
Do I need legal expertise to use the tool?
No. The generator guides step by step with references to each article of Regulation (EU) 2023/988. Does the documentation include the formal risk analysis required by Article 9(2)?
Yes. Where appropriate, the documentation must also include an analysis of the possible risks and the solutions adopted to eliminate or mitigate them, as well as the list of relevant European standards applied.
