MISTAKE 1 — DEFAULT PENALTY

Accepting the default value when actual emissions are far lower

The Mozambique default of 4.353 tCO₂e/t is one of the highest for aluminium globally because default values include a mark-up (Annex IV, point 4.1). Hydro-powered actual emissions could be a fraction of this. Not pursuing actual emissions data costs real money in unnecessary CBAM certificates.

Treating all non-EU aluminium as equally carbon-intensive

Art. 26(1): an authorised CBAM declarant who fails to surrender the required certificates by 30 September faces a penalty identical to the excess emissions penalty under Art. 16(3) of Directive 2003/87/EC, increased pursuant to Art. 16(4). The penalty applies per certificate not surrendered. Payment does not release the obligation to surrender outstanding certificates (Art. 26(3)).

Frequently asked questions

Why is the Mozambique default value so high if the smelter uses hydroelectricity?
Default values under Implementing Reg. (EU) 2025/2621 include a mark-up (Annex IV, point 4.1) and are based on available data which may not fully reflect installation-specific electricity sources. Art. 7(2) allows you to use verified actual emissions instead of defaults, which for hydro-powered production would be substantially lower.
How do I switch from default values to actual emissions?
Under Art. 7(2)(a) and Annex IV, you need installation-specific emissions data verified by an accredited verifier under Art. 8 and Annex VI. CBAMCheck generates the supplier letter requesting this data and the Annex V record template for the documentation.
Does Mozambique have a carbon price?
No. Mozambique has no carbon pricing mechanism. No Art. 9 deduction applies. The cost advantage for Mozambican aluminium under CBAM comes entirely from potentially lower actual emissions, not from a carbon price deduction.
Is this a subscription?

Can I get a refund?
Upon activating the licence you give express consent for immediate generation of digital content pursuant to Art. 16(m) of Directive (EU) 2011/83, waiving the 14-day withdrawal right. Refunds are accepted only for a reproducible technical fault.
What if the regulation changes?
If the regulation changes during your licence validity, you can regenerate the document with the updated version of the generator at no extra cost.
